Rice Parsons Leoni & Elliott LLP has filed a proposed class action lawsuit against Apple Inc. and Apple Canada Inc., on behalf of Canadian creators whose works were used without authorization to train Apple’s generative AI programs.
The action alleges that Apple reproduced, used, and appropriated original literary, dramatic, musical and artistic works, belonging to Canadians and protected by copyright, to develop their large language models (“LLM’s”), including Apple Intelligence, and that this copyright infringement led to financial gain for Apple and deprived copyright holders of control and dignity over their work, and denied them financial compensation for their labour and skill.
