RHE secured a $2,992,358 settlement for a 34-year-old father whose vehicle was hit by a drunk driver, causing him and his two children in the vehicle to be injured.  The father’s injuries were significant and included an injury to the right foot and ankle which resulted in a below the knee amputation of his right leg, neuropathic pain, sprained ribs, psychological impairments, and injury to his back.

This individual’s circumstances entitled him to a claim for non-pecuniary damages, loss of future income earning capacity, future care costs, an in-trust claim for his wife who missed work to provide care to him and their children, damages for diminished housekeeping capacity, and reimbursement for his out-of-pocket expenses. This settlement also included claims for both his children who were in the vehicle when the collision occurred.


 
$2.5 million for a young teacher who sustained a traumatic brain injury when she was struck as a pedestrian on a sidewalk as two vehicles collided with one another. (Mattock, Megan)

RHE obtained a $2,500,000 settlement for a young woman who was standing on a sidewalk when two vehicles violently collided with one another and struck her, causing her to be thrown to the concrete and knocking her unconscious. The impact caused her to sustain a traumatic brain injury, leaving her permanently and totally disabled with no meaningful work capacity. Her debilitating injuries required her to move in with her family for a period after the accident and she continued to rely on family support for an extended period after she recovered enough to live independently.

Because of the accident, she suffers from constant pain, daily headaches, requires the use of a walking stick, regularly gets so dizzy she vomits, and has gained a significant amount of weight. She may also no longer be able to have children since she is unable to meet the physical and mental demands of caring for them.

Her circumstances permitted a claim for non-pecuniary damages, substantial compensation for past and prospective future wage loss, an extraordinary claim for lifetime care costs and a tax gross-up award, which is an additional sum of money awarded to ensure that the interest earned on a future care award does not prematurely erode because of taxes owed. Her settlement also included an in-trust claim for her parents and sister who provided her extensive support after the accident and reimbursement for out-of-pocket expenses incurred because of the accident.


 
$2.17 million for a child who sustained debilitating injuries in utero when his mother was involved in a head on collision, resulting in him being born prematurely via an emergency c-section. (Thomson, Mattias)

RHE obtained a $2,172,326 settlement for a child who had to be prematurely delivered via an emergency caesarean section after his mother and father were involved in a head on collision. As a result of his pre-term birth, he developed cerebral palsy and considerable developmental delays. Upon delivery, he was blue, unresponsive, and had bruising.  He was intubated and ventilated due to his overall prematurity and struggles with breathing.  The accident caused him to sustain a traumatic brain injury, which resulted in a hormone disorder causing developmental delays, among other issues.

The constellation of his ongoing symptoms continues to limit him in every aspect, and he will never have a normal life.  He takes growth hormones to assist with his stature, but his brain damage is so severe that the cognitive impairments are permanent.  He is extremely limited in his future employment opportunities, and his career trajectory is highly uncertain.  He will spend the rest of his life with considerable ongoing support.


 
$1.89 million for a 23-year-old social worker who sustained serious physical, cognitive, and psychological impairments as a passenger in a fatal motor vehicle collision occurring at high-speed. (Odland, Morgan)

RHE obtained a $1,891,473 settlement for a 23-year-old social worker who was a passenger in a vehicle being driven by her boyfriend when it was struck head-on by another vehicle at highway speed.  Paramedics attended the scene of the accident and described our client as being pinned and confused with a decreasing level of consciousness.  It took an hour to extricate her from the vehicle.  Both her boyfriend and the driver of the other vehicle died as a result of the collision.

After the accident, she remained in hospital for approximately seven weeks to manage her injuries.  She required multiple surgeries for a knee injury, small bowel resection, and for fractures in her neck, thigh, and elbow. She also sustained a traumatic brain injury which impacted her cognitive functioning and she had blood clots which traveled to her lungs, requiring prompt medical attention. She required nearly two years off work after the accident.

She was able to eventually return to some part time work as a counselor, but she is unable to engage in full-time work. Despite many years passing since the collision, she continues to suffer from chronic pain, persistent post-traumatic headaches, cognitive difficulties, psychological impairments, chronic sleep disruption, and multiple body scars.


 
$1.45 million for a 36-year-old former recruitment specialist who suffered serious physical, cognitive, and psychological injuries when she was struck as a pedestrian in a marked crosswalk by a vehicle traveling over 40 km/h. (Cruz, Gretchen)

RHE obtained a $1,449,342 settlement for a 36-year-old former recruitment specialist who suffered serious physical, cognitive, and psychological injuries when she was struck as a pedestrian in a marked crosswalk by a vehicle traveling over 40 km/h.  The accident left her permanently disabled from her prior work in recruiting and sales, and likely, from any kind of meaningful full-time employment. 

Physically, she now experiences constant pain in her neck, shoulders, back, and left leg.  She experiences daily and long-lasting headaches.  She has scarring on her arm and elbow from the lacerations caused by the impact with the Defendant’s vehicle. Cognitively, she suffers from difficulties with memory, focus, concentration, word finding, and processing speed.  She is hyper-sensitive to light and sound.  She continues to experience significant dizziness and vestibular issues. Psychologically, she continues to suffer from anxiety and major depression.  Her sleep is interrupted on a nightly basis, and she wakes up feeling unrested and irritable. She experiences wildly vacillating mood swings. Since the collision, this individual has attended hundreds of treatment sessions, totaling more than $100,000. 

Despite her efforts, her injuries, symptoms, and resultant limitations have proven chronic and permanent. As such, this settlement included a claim for non-pecuniary damages, a claim for past and prospective income loss, compensation for her anticipated future care costs, reimbursements for her out of pocket expenses, as well as compensation for income tax losses and management fees.


 
$1.25 million for a 21-year-old who suffered life-altering injuries in a traumatic motor vehicle accident. (Giller, Maygan)

RHE obtained a $1,255,000 settlement for a 21-year-old who sustained life-altering injuries in a motor vehicle collision caused by another driver attempting an unsafe U-turn. The collision caused this individual to sustain cognitive, psychological, and physical injuries and impairments. Cognitively, the collision caused dizziness, memory deficits, and confusion. Physically, she sustained a concussion with post-concussion syndrome and injury to her neck, back and shoulders, all of which resulting in chronic pain and chronic headaches. The collision also caused injury to her mental health and brought about insomnia.

She was young when the accident occurred, but she aspired to become a nurse. Unfortunately, her injuries have had a significant and long-lasting impact on her physical and psychological well-being. Her accident-related injuries delayed her from pursuing a stable career and prevented her from engaging in full-time work, significantly impacting her income earning capacity. As such, she was entitled to a significant claim for her future income loss. This settlement also included a mid-range claim for non-pecuniary damages, reimbursement for past income loss, for out-of-pocket expenses, and future care costs.


 
$1.03 million for a 49-year-old locomotive engineer who sustained life altering injuries as a motorcyclist struck by a negligent driver. (Rykyta, Graham)

RHE secured a $1,030,474 settlement for a 49-year-old locomotive engineer who sustained life altering injuries in a motor vehicle accident. Before the collision, this individual was healthy and excelled at his job, with no physical injuries or limitations. However, he was seriously injured when he was riding his motorcycle through an intersection and another driver negligently turned into the intersection and collided with him, causing him to crash. He was taken by ambulance to the hospital to treat his injuries. The collision caused him to sustain chronic tissue injuries, chronic myofascial pain syndrome, chronic back pain, psychological injury, and sleep disruptions.

After the accident, he required several months off from work to focus on his healing and rehabilitation.  He was prescribed several pain medications that caused him unbearable gastrointestinal side effects which impaired his ability to effectively perform his work duties and ultimately led to him being let go from his employment. Had the accident not occurred, he would have continued to earn upwards of $200,000 annually until his early 70s. His circumstances entitled him to a claim for non-pecuniary damages, a significant amount of past wage loss, a lifetime loss of income earning capacity, lifetime future care costs, and reimbursement for his out-of-pocket expenses.


 
$1.02 million for a 46-year-old psychiatric nurse who, after sustaining chronic physical and psychological injuries in a motor vehicle collision, was left partially and permanently disabled from her direct patient care role. (Arriola, Rosa)

RHE secured a $1,023,900 settlement for for a 46-year-old registered psychiatric nurse who sustained multiple injuries in a motor vehicle collision. At the time of the accident, she was working full-time in direct patient care, a role she considered her calling. Following the collision, she was diagnosed with soft tissue injuries, whiplash, and concussion. Despite attempting to return to work on a gradual basis, her ongoing pain and physical limitations forced her to ultimately step away from hands-on nursing after two difficult years. Although her employer accommodated her by providing her with an administrative role, she continued to experience chronic pain, cognitive difficulties, post-traumatic migraines, and persistent mental health symptoms, all of which significantly impact her daily life and relationships.

Her treatment regimen involved physiotherapy, Botox injections, active rehab, counseling, and medications, with varying degrees of relief. She continues to struggle with daily activities, recreation, and household responsibilities, relying more heavily on her spouse. She is considered partially and permanently disabled from returning to full-time, physically demanding work. The settlement obtained reflects an award for non-pecuniary damages for her pain and suffering, along with substantial amounts for past and future income loss due to her reduced earning capacity. It also covers future care costs, including ongoing medical treatment and therapies, and reimbursement of out-of-pocket expenses related to her care and rehabilitation.


 
$997,982 for a 42-year-old business executive and former triathlete who suffered a stroke and permanent neurological impairments after a devastating cycling collision and subsequent aggravating motor vehicle accident. (Zivkovic, Ivan)

RHE secured a $997,982 settlement for a 42-year-old business executive who suffered catastrophic and life-altering injuries in two motor vehicle collisions. The first collision occurred when he was cycling and a vehicle cut across his path, causing him to strike the car and be thrown onto the road. This collision caused a hand fracture, bicep injury, and a tear in an artery of his neck which led to a serious stroke a few weeks later. The second collision, involving a semi-truck striking his vehicle, significantly aggravated his pre-existing soft tissue injuries, mental health conditions, and sleep dysfunction, worsening his overall condition.

Prior to the accidents, the client was a healthy, high-performing 37-year-old triathlete with no physical or psychological issues and a flourishing career in the energy sector. Following the stroke and ongoing complications, he was off work for 6–7 months and has since struggled to reintegrate professionally, facing permanent neurological impairments including vision, hearing, and auditory processing deficits that severely impact his ability to perform his forward-facing role in business development. These limitations extend to every facet of his life, including diminished recreational capacity, changes in personality, and strained family relationships. The consensus medical opinion is that his current state will continue, and he will be left with these significant changes in his function permanently.

The settlement achieved reflects an award for pain and suffering, reimbursement for past income loss and out-of-pocket expenses, and a significant award for loss of future earnings and future care costs, recognizing the profound and permanent impact the collisions have had on his health, career, and quality of life.

Her medical team recommended she return only part-time due to her health limitations, which are expected to persist long term, significantly reducing her competitiveness in the legal market, particularly in private practice where long hours are the norm. The settlement includes an award for non-pecuniary damages, reimbursement for past income loss and out-of-pocket expenses, and substantial compensation for her future income loss and care costs, acknowledging the devastating and permanent impact the defendant’s negligence has had on her personal and professional future.

Once a hardworking and resilient woman with a promising future, she now faces permanent limitations that have deeply affected her quality of life, career, and mental well-being.

This settlement provided for non-pecuniary damages, reimbursement for past income loss and out of pocket expenses, as well as a claim for loss of housekeeping capacity, future income loss, and future care costs.


 
$742,500 for a young woman whose life was upended by a rear-end collision that left her with chronic pain, cognitive decline, and worsening mental health, forcing her to abandon her education and career goals. (Gravenor, Destiny)

RHE secured a $742,500 settlement for a 22-year-old woman who suffered multiple physical and psychological injuries in a rear-end collision while riding as a front-seat passenger. She sustained a fractured sternum, microfractures to her thoracic spine, soft tissue injuries, and a suspected mild traumatic brain injury, alongside persistent cognitive issues, including memory and concentration difficulties. Despite her best efforts to recover through physiotherapy, massage, counselling, and other treatments, her pain and functional limitations became chronic and significantly disrupted her life. She was forced to quit both her job and her post-secondary studies as a result of her symptoms.

Prior to the collision, she was a high-functioning and ambitious young woman living independently, managing all aspects of daily life while pursuing her goal of becoming an art therapist. Although she had a pre-existing mental health history, it was under control and not interfering with her work or studies. The collision caused a marked decline in her mental health, aggravating her psychological vulnerability and leaving her in a prolonged state of sadness and hopelessness. The persistent physical pain and cognitive impairments have permanently altered her career path, independence, and quality of life.

This settlement included an award for non-pecuniary damages, damages for past and prospective income loss, future care costs, and reimbursement for out-of-pocket expenses, reflecting the profound and enduring impact the collision has had on her health, independence, and future potential.


 
$708,712 for a young denturist whose life and career trajectory were permanently altered by three rear-end collisions that left him with chronic pain, structural injuries, and lasting physical limitations. (Kumar, Akash)

The firm secured a $708,712 settlement for a 33-year-old man who sustained chronic and functionally limiting injuries in three rear-end collisions occurring between 2017 and 2018, the first of which occurred when he was just 26. Prior to these incidents, he was in excellent health, active in competitive sports and Olympic lifting, and on track to become a denturist. As a result of the first two collisions, he suffered muscle injuries to his neck, upper and lower back, and shoulders, which were further aggravated by the third and most severe collision. Fabrication work essential to his denturist duties significantly aggravates his symptoms, forcing him to delegate much of it to others. He now relies on scheduled breaks, stretching, and rest to manage his pain while reducing the scope of both his professional and personal activities. The injuries also limit his ability to play sports or remain physically active, reducing his overall quality of life.

Given his young age, lack of pre-existing conditions, persistence of symptoms, and the long-term impact on his earning capacity, the settlement included significant compensation for past and prospective income loss, future care costs, and reimbursement for out-of-pocket expenses, in addition to an award for non-pecuniary damages.

Their collective negligence not only caused the father’s death but also inflicted lasting psychological trauma on his daughters. The sisters’ claims were not barred by a liability waiver their father signed, as the Infants Act prohibits waiving a minor’s right to bring a tort claim in damages. She is now heavily reliant on her mother and father. Her injuries have proved catastrophic not only for herself, but for those friends and family who have been enveloped by the devastating effects of her brain injury. 

Because of the accident, she was unable to complete her schooling and dropped out of school before reaching high school. As a young woman with profound changes in her cognition and personality, her unfortunate circumstances permitted a claim for non-pecuniary damages near the upper limit. Further, because she is now precluded from all but the most basic jobs that society has to offer and will always be attempting to perform the duties of those jobs with profound cognitive and emotional limitations, this settlement included a significant amount of damages to compensate her for her loss of future income. Wrongful Insurance Denial

RHE secured a $2,149,527 settlement for the executors of an estate who were improperly denied payment of the deceased’s life insurance policy. The deceased individual had $ 3.2-million-dollar life insurance policy before passing away at 56 years old due to leukemia. After his passing, the executors of the will rightfully applied for payment of the insurance proceeds but were denied on the grounds that the insurance policy was void – the insurer alleging that the deceased had failed to disclose a material fact in his insurance application, making the policy void.

RHE brought a claim against the life insurer and the plaintiff’s broker, alleging that the provider ought to be vicariously liable for the negligent conduct of its insurance agent. Specifically, when the agent created the life insurance policy, he included incorrect information, failed to properly inform the client, and failed to include sufficient information in the application. This resulted in a successful settlement for the executors of the estate.
